“The mutual combat doctrine arose back in the mid-1990s. And since that period of time, there have been maybe seven or eight cases that have worked their way through the appellate courts,” the plaintiff-appellants argued. “All those cases have one thing in common. The combatants had absolutely no connection whatsoever with the establishment.”        

“A reasonable person who is not motivated by political or ideological considerations or a desire to affect the outcome of Supreme Court cases would conclude that this event does not meet the applicable standard for recusal,” the justice wrote in a letter to lawmakers.        

Chancellor Kathaleen McCormick said she’s holding defense counsel to their word and will leave the door open for the motions to be raised again if they don’t keep it.        

While it likely won’t influence any of his political supporters, a guilty verdict would open many a can of worms on what comes next.
